These Terms and Conditions govern your use of the Fort Myers Concrete & Masonry website located at masonryfortmyers.com and any services you engage us to perform. By visiting this website or requesting services, you agree to these terms. Please read them carefully.
By accessing or using this website, submitting a contact form, or engaging Fort Myers Concrete & Masonry to perform work, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use this site or our services. We reserve the right to update these terms at any time, and continued use of the site after changes are posted constitutes acceptance of the revised terms.
Fort Myers Concrete & Masonry is a masonry contractor based in Fort Myers, FL. Our services include, but are not limited to, foundation repair, chimney repair, tuckpointing, brick repair, driveway pavers, retaining wall construction, masonry restoration, fireplace installation, stone veneer installation, concrete block walls, walkway construction, and related masonry and concrete work.
All services are performed in Fort Myers and the surrounding Southwest Florida communities. This website is intended for informational purposes and to facilitate contact between potential customers and our business. The site does not constitute a binding contract or guarantee of service availability.
On-site estimates are provided at no charge and without obligation. All estimates are based on the conditions observed at the time of the site visit and the information provided by the customer. Estimates are valid for 30 days from the date of issuance unless otherwise specified in writing.
Final project costs may differ from initial estimates if hidden conditions are discovered during work (such as unseen structural damage, utility conflicts, or differing soil conditions), if the customer requests changes to the scope of work, or if material prices change materially between the estimate and the start of work. Any changes to scope or price will be communicated and agreed upon in writing before additional work proceeds.
Project start dates are confirmed in writing at the time of contract execution. Schedules are subject to change due to weather conditions, permit delays, material availability, or other factors outside our control. We will notify you as soon as possible of any significant scheduling changes.
If you need to cancel or reschedule a scheduled project, please notify us in writing at least 48 hours in advance. Cancellations made after work has begun may result in charges for work completed and materials ordered or delivered to the job site. Deposits paid are non-refundable if the customer cancels after materials have been ordered or work has started.
Payment terms are outlined in the written estimate or contract provided before work begins. A deposit may be required to secure scheduling and order materials. The remaining balance is due upon completion of the project unless other terms are agreed upon in writing.
Invoices not paid within the agreed timeframe may be subject to a late payment fee as specified in the written contract. Fort Myers Concrete & Masonry reserves the right to withhold warranties on work that has not been paid in full.
Where required by local ordinance, Fort Myers Concrete & Masonry will obtain applicable building permits and schedule required inspections through Lee County or the relevant municipality. Permit fees are the responsibility of the customer and will be itemized in the written estimate. We do not perform work that requires permits without obtaining them. Customers who request permit-free work in violation of local requirements do so at their own risk and relieve Fort Myers Concrete & Masonry of any associated liability.
Warranty terms, if any, are specified in the written contract for each project. Where a workmanship warranty is provided, it covers defects directly attributable to the work performed by Fort Myers Concrete & Masonry. Warranties do not cover damage caused by events outside our control, including but not limited to hurricanes, flooding, earthquakes, vehicle impact, or modifications to our work made by others.
Material warranties, where applicable, are governed by the respective manufacturer and are separate from any workmanship warranty. Fort Myers Concrete & Masonry will assist in facilitating manufacturer warranty claims where possible but is not responsible for the terms or fulfillment of third-party manufacturer warranties.
To the fullest extent permitted by applicable law, Fort Myers Concrete & Masonry shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of this website or from any services performed, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to services performed shall not exceed the total amount paid by you for the specific project giving rise to the claim. Nothing in these terms limits liability for gross negligence or intentional misconduct.
The information on this website is provided on an "as is" basis without warranties of any kind, either express or implied. Fort Myers Concrete & Masonry makes no warranty that the website will be error-free, uninterrupted, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any content on this site. General cost ranges or timelines referenced on this site are illustrative only and do not constitute a binding estimate for any specific project.
In the event of a dispute arising from or related to services performed by Fort Myers Concrete & Masonry, both parties agree to first attempt to resolve the matter through good-faith negotiation. If negotiation does not resolve the dispute within 30 days, either party may pursue mediation through a mutually agreed-upon mediator before resorting to litigation.
Any legal action that cannot be resolved through negotiation or mediation shall be brought exclusively in the state or federal courts located in Lee County, Florida. Both parties consent to the personal jurisdiction of those courts.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes shall be resolved in courts located in Florida as described in Section 10.
We may revise these Terms and Conditions at any time by updating this page. Changes take effect immediately upon posting unless otherwise noted. We encourage you to review these terms periodically. Continued use of this website or engagement of our services after changes are posted constitutes acceptance of the revised terms.
